Indem man die Ergebnisse des Gutachtens bewertet muss man nicht vergessen, dass es keine Handlungsanweisung sondern nur einen Studie ist. Die Beschlüsse, die für die Überprüfung des Falls relevant sind, könnten nur vom Staatschef gefasst werden. Nur der Präsident kann den Staatsanwalt beauftragen, den fall neu aufzurollen, erzählte in einem Interview mit der Stimme Russlands das Ratsmittglied Igor Jurgens.

«Nur die Staatsanwaltschaft kann nach den sich neu ergebenden Umständen und unter Berücksichtigung der Meinung der Experten für die Aufhebung des Urteils plädieren. Ich widerhole es aber noch mal, dass dies allein der Präsident entscheiden kann. Und unsere Empfehlung besteht gerade darin.»

Al caracterizar los resultados del peritaje, es importante recordar que no son guías para accionar, sino simplemente los estudios. Decidir si son un fundamento suficiente para revisar el caso, es la prerogativa del jefe de Estado. Sólo el Presidente puede dar la orden al Fiscal General para realizar otro proceso judicial, comentó en su engtrevista a La Voz de Rusia Igor Yurguens, miembro del Consejo Presidencial:

«Las recomendaciones, preparadas para el caso de Jodorkovsky y Lebedev, serán entregadas al Presidente. En ellas se demuestra convincentemente que la vía más civilizada para salir de esta situación sería remitir todos estos materiales al Fiscal General. Y sólo éste, en base a las circunstancia nuevamente descubiertas y considerando las opiniones de los expertos, gestione la casación de la sentencia. Pero, repito una vez más, esto corresponde a la competencia del Presidente de la Federación Rusa. Nuestro consejo radica justo en eso. Pero cómo realizarla, es su pleno derecho constitucional».

Оцењујући резултате експертизе важно је имати у виду да они нису упутство за деловање, већ само истраживање. Одлуку да ли су они довољна основа за поновно разматрање случаја треба да донесе председник државе. Само председник може да да налог генералном тужиоцу да се понови процес, рекао је у интервјуу за Глас Русије члан Председничког савета Игор Јургенс.

«Припремне препоруке о случају Ходорковског и Лебедева ће бити предате председнику. У њима је врло убедљиво показано да је најцивилизованији начин да се изађе из ове ситуације предаја ових материјала у Генерално тужилашво. И само оно би, на основу нових оклоности и узимајући у обзир мишљење експерата, ургирало да се укине пресуда».

MEDVEDEV TO VOW REFORM IN FAREWELL ADDRESS

President Dmitry Medvedev on Thursday is expected to vow a revamped reform drive in Russia after protests rattled the authorities, in his final annual address to the nation as head of state. (...)

A pro-reform think tank said Thursday that Russia's political system had become increasingly divorced from the social reality in the country while its leaders had little idea how to respond.

«Russian society does not just want to know its future but to have a say on where the authorities want to take it,» the directors of the Institute of Contemporary Development (INSOR) said.

«The problem of the authorities is that they did not want to hear or feel this,» they said in an article for the Nezavisimaya Gazeta.

Now, a decade of stability and an explosion in internet connectivity widen the gulf between Russians and their authoritarian government.

Igor Yurgens runs a think tank here. He says 90 percent of Moscow's adults are now online, while government bureaucrats remain «feudal.»

«I am hearing retired people, not very well dressed, who are on the internet saying to each other that 'I found a new hearing device,' It is a change of existential order,» Yurgens said. «Feudalism versus modernization all in one basket which is not healthy which will find its resolution. Either evolutionary, for which I have a lot hope, or revolutionary, which I hope we avoid we have had our share.»

Tamara Morshchakova argues: “This subject is becoming a public issue. Society has matured to understand the problem, among other reasons, due to the analysis. Authorities are watching an awakening of civil society.”

The head of the Institute of Contemporary Development, and one of the authors of the report, Igor Jurgens agrees with his colleague: “In the second Yukos case, the violations are so serious that we should either pardon the defendants or start a new investigation.” In an interview with NG, he stressed: “If we want to avoid major social conflicts, it is highly important to conduct these types of analyses. On the other hand, we heard Putin and Medvedev’s statements that they do not do anything due to pressure.” Jurgens recalls that the report was presented two days ahead of the rally on Sakharov Avenue, which promised to have high attendance numbers: “Perhaps, authorities see concessions to civil society as a weakness. It is important for both sides not to cross the fine line, in order to avoid a power vacuum, on the one hand — which is dangerous to everyone, and on the other hand, it is necessary to yield to the just demands of the people, who believe that the political system must change.”

It would have been a more appropriate reaction on Medvedev's part, Jurgens argues, if he had instructed the Prosecutor General’s Office and other law enforcement agencies to investigate the circumstances of the numerous violations noted by the experts.

VERDICT AGAINST KHODORKOVSKY COULD BE REVIEWED

Only the President enjoys the right to instruct the Prosecutor General’s office to conduct a retrial, says a member of the Presidential Council Igor Yurgens in an interview with the Voice of Russia.

“Only the Prosecutor General can lodge a motion to annul the verdict based on new circumstances and taking into account the opinion of experts. But this is of the President’s competency,” emphasized Igor Yurgens.
